திலீபன் ஒரு பயங்கரவாதியா இல்லையா சுமந்திரன் ஐயா அவர்களே?

சொல்லுங்கள் ஐயா, சொல்லுங்கள்?

The Batticaloa Magistrate A.C. Rizwan has directed that several persons taken into custody over an event commemorating deceased LTTE combatant Rasaiah Parthipan alias ‘Thileepan’ be released. Counsel for the accused, M.A. Sumanthiran is reported to have stated during the hearing that the Police had misled the court claiming that Thileepan had died during combat operations.

Thileepan, reported to have been dying either of natural causes or a wound in the stomach sustained during combat, undertook a fast-unto-death in September 1987, eventually died on the 26th of that month.

Sumanthiran is correct. Thileepan may have died as a result of combat operations, but he did not die in combat. The claims made by some that he sustained a deadly injury is not confirmed either. He died. It is not established that he died in battle. He died while on a hunger strike. Whether he died OF the hunger strike is not established either. BUT, he did not die in battle, let us repeat. Sumanthiran is correct, let us repeat.

What he told reporters after court proceedings is also correct: commemorating any dead person as per his/her religious faith is not a crime.

Technicalities. All fair. Sumanthiran is a lawyer. He knows the points. He knows the pauses, the punctuation, the twists and turns. So let’s leave these aside and ask him some direct questions:

  1. LTTE ஒரு பயங்கரவாத அமைப்பா இல்லையா (Was or was not the LTTE a terrorist organization)?
  2. ராசய்யா பார்த்திபன் அதாவது திலீபன் ஓர் LTTE போராளியா இல்லையா (Was or was not Rasaiah Parthipan alias Thileepan an LTTE cadre)?
  3. ஆம் எனில், அவர் ஒரு பயங்கரவாதி இல்லையா (If yes, was he or was he not a terrorist)?
  4. இந்த எல்லா கேள்விகளுக்கும் உங்கள் பதில் ‘ஆம்’ என்றால் சட்டம், குடியுரிமை, ஜனநாயகம், நாகரிகம் போன்றவை குறித்து பூசி மெழுகும் உங்கள் சொற்பொழிவுகளில் , இந்த உண்மைகளை நீங்கள் ஏன் விவரிக்கவில்லை – நீதிமன்றத்தில் இல்லையென் றாலும் குறைந்தபட்சம் வெளியிலாவது பேசியிருக்கலாமே (If ‘yes’ is the answer to all these questions and since you wax eloquent on law, citizenship, democracy, civilization etc etc etc., why do you leave these facts out of the narrative — if not in court, then at least outside)?
